What is Oregon BPS?

The Oregon Building Performance Standard (Oregon BPS) is a mandatory program that aims to bring awareness about building energy use to owners of existing commercial buildings, and to reduce energy use and utility costs for less efficient buildings.

Who Must Comply

Tier 2 buildings are required to report Energy Use Intensity and Energy Use Intensity Targets by their July 1, 2028, compliance date. Tier 1 buildings are required to report Energy Use Intensity and Energy Use Intensity Targets and submit operations & maintenance and energy management plans by their compliance date.

Oregon BPS Compliance Services

In 2023, the Oregon Legislature passed House Bill 3409, establishing an  Energy Performance Standard policy for commercial buildings, often referred to as a Building Performance Standard (BPS).

Tier I Service Fees ( ≥35k Sq.ft )

Tier I: Basic Requirements

  • Submit an application for a building (or a group of buildings)
  • Determine the Energy Use Intensity Target (EUIt) based on building type and operation
  • Calculate the Energy Use Intensity (EUI) from 12 continuous months of utility bills
  • Energy Management Plan (EMP)
  • Decarbonization Plan for grouped buildings with district systems

$3.00/sf + $0.05 per kBtu saved >15 (capped at 50% of project cost).

Example: 100k ft² office → $85k–$200k+ incentive

Tier I: Compliance Follow-Up Measures

For those Missing Targets:

  • Report on their expected status 180 days before compliance date
  • Complete an Energy Audit and Life Cycle Cost Assessment before their compliance date
  • Implement cost-effective energy efficiency measures that reduce EUI
  • Calculate and report the building’s updated EUI as milestones are reached

Tier II: Building Type Definitions

  • Tier 2 buildings are 20,000–35,000 sq. ft., owned by one entity.
  • Special Tier 2 are ≥35,000 sq. ft. with large specialized spaces.
  • Extended Tier 2 are ≥35,000 sq. ft. grouped with a Special Tier 2 building.
  • Nonresidential excludes lodging types; hotels provide overnight rooms and guest services.

What is Oregon BPS compliance?

The Oregon Building Performance Standard (Oregon BPS) is a mandatory program that aims to bring
awareness about building energy use to owners of existing commercial buildings, and to reduce
energy use and utility costs for less efficient buildings.

The State of Oregon adopted new energy performance requirements for commercial and multifamily buildings. These are in addition to Portland’s commercial energy reporting requirements; here is what commercial property owners need to know.

All public and privately owned buildings, which meet the definition of a Tier 1 or Tier 2 covered building are subject to the requirements of the  Buildings Performance Standard.

Tier 1 :

  • Buildings greater than 35,000 square feet
  • Does not include multifamily residential buildings
  • Requirements: Benchmarking, energy management plan (EMP), operations and maintenance (O&M) program and performance metric
  • Mandatory compliance begins in 2026 for buildings over 220,000 square feet

Tier 2 :

  • Buildings greater than 20,000 to 35,000 square feet
  • Includes multifamily residential buildings greater than 20,000 square feet
  • Requirements: benchmarking, energy management plan (EMP) and operations and maintenance (O&M) program
  • Mandatory reporting July 1, 2027

Compliance with the  Buildings Performance Standard is different depending on the size of your building. Tier 1 is buildings greater than 35,000 sf. Tier 2 is buildings greater than 20,000 sf to 35,000 sf and all multifamily buildings greater than 20,000 sf.
