In 2023, the Oregon Legislature passed House Bill 3409, establishing an Energy Performance Standard policy for commercial buildings, often referred to as a Building Performance Standard (BPS).

The State of Oregon adopted new energy performance requirements for commercial and multifamily buildings. These are in addition to Portland’s commercial energy reporting requirements; here is what commercial property owners need to know.
All public and privately owned buildings, which meet the definition of a Tier 1 or Tier 2 covered building are subject to the requirements of the Buildings Performance Standard.
Compliance with the Buildings Performance Standard is different depending on the size of your building. Tier 1 is buildings greater than 35,000 sf. Tier 2 is buildings greater than 20,000 sf to 35,000 sf and all multifamily buildings greater than 20,000 sf.
